HIGH COURT OF MALAYA

Under Section 2 of the Court of Justice Act 1964 provides that the High Court refers to the High Court of Malaya and the High Court of Sabah and Sarawak. Therefore, the jurisdiction of the High Court of Malaya is equivalent (coordinate) with the High Court of Sabah and Sarawak. In general, the High Court of Malaya and the High Court of Sabah and Sarawak have the same role and function, namely:

  1. Hearing or discussing criminal cases involving the death penalty.
  2. Hearing and deciding civil cases that exceed the jurisdiction of the Sessions Court and the Magistrate's Court where the amount of claims involved exceeds RM1,000,000.00
  3. The High Court also has exclusive jurisdiction to hear disputes regarding cases:
    1. Divorce and matrimonial issues
    2. Admiralty
    3. Bankruptcy
    4. Company civil disputes
    5. Appointment and supervision of guardians of children and property
    6. Appointment and supervision of people with disabilities and property
    7. Power of attorney to administer and Probate
    8. Hearing election petitions
    9. Hearing and determining appeals for criminal and civil cases from the Sessions Court and the Magistrate's Court.
    10. Reviewing decisions from Lower Courts, Tribunals and other bodies that have a quasi-judicial function.
    11. Supervise the travel and administration of the Certificate of Practice Unit.

 

FUNCTIONS OF THE KUALA TERENGGANU HIGH COURT REGISTRATION OFFICE

  • Perform general administrative tasks, get feedback related to logistics, inventory and asset needs.
  • Regulating the discipline of Deputy Registrars, Senior Assistant Registrars and Staff.
  • Responsible for the registration of civil and criminal cases filed in the High Court of Malaya in Kuala Terengganu.
  • Regulating the progress of civil and criminal cases registered in the Kuala Terengganu High Court.
  • Regulating the lawyers appointed by the Court for Accused Persons with charges that carry the death penalty according to Practice Instruction No. 1 Year 2017.
  • Responsible for the registration of Appeal cases from the Lower Courts (Sessions and Magistrates' Courts).
  • Responsible for providing statistics on civil and criminal cases for the High Court of Malaya in Kuala Terengganu.
  • Responsible for implementing instructions from the Office of the Registrar General of the Federal Court of Malaysia from time to time.
